Terms & Conditions - Effective February 22, 2016

PAYMENTS:

-US Customers – CREDIT CARD ONLY.

-Credit Card information is required at the time the order is submitted.

-Your card will be charged on the day the order is shipped.

LEAD TIMES & BACKORDERS:

-Orders are usually shipped within 72 hours from the UTN receipt order date unless stated otherwise at the time of the order.

-BACKORDERED items will be shipped out automatically within 45 days of the original order unless cancelled in writing to UTN. 

CLAIMS & RETURNS:

-All returns and claims for defects and shortages must be made within 15 days of the invoice date.

-An RA# (Return Authorization) MUST be obtained from your sales rep for all returns.

-RA#’s will be granted for defective goods only. UTN will pay freight for the return of defective items and, either replace the items or credit your account.

-Returns without an RA # will be refused.

-Retail customers who receive defective goods should contact the store where the item was purchased, NOT Under the Nile headquarters. UTN will be responsible for freight charges of defective goods only.

CANCELLATIONS:

-Orders and pre-orders cancelled within 30 days of the ship date will be assessed a 20% cancellation/restocking fee.

PRICES:

-All prices are subject to change without notice.

-All goods will be shipped at prices in effect at the time the order placed, plus shipping and handling costs.

MAP POLICY:

 --We have implemented a Minimum Advertised Price (MAP) policy to protect the integrity of Under the Nile and retailers who carry our products.  Manufacturer’s Suggested Retail Price (MSRP) is keystone plus $1.00 no exceptions unless otherwise noted by Under the Nile.

-Under the Nile has put in place a “3 strikes” policy.  Any company found in violation of our MAP policy will be contacted and reminded to comply. On the third strike, Under the Nile will suspend sales of our products to you.

-MAP pricing policy does not apply to items on our promotional list.

SALES PROMOTIONS:

-Four (4) sales are allowed per year:

Earth Day

4^th of July

Thanksgiving Weekend (including Cyber Monday)

Week after Christmas

-Under the Nile will send an “Approved for Sale Event” schedule of goods allowed in the promotion 2 weeks prior to the event.

MINIMUMS:

-Minimum opening order per season: $350

-Minimum order of toys only: $250

-Reorder within the same season: $150

-Open Stock:

            6 piece minimum per style, 2 per size

-Accessories, Toys and One Size (OS) items

            3 piece minimum per style

-Under the Nile has two seasonal catalogs per calendar year, new season starts

January 1^st and August 1^st of each year.
